NemesisBird LLC Tours Terms & Conditions
Upon registering for a NemesisBird LLC program (henceforth NemesisBird, NemesisBird Tour(s), or tour), you (the participant) agree to be bound by these terms of service, our cancellation policies, and all applicable laws and regulations, and you agree that you are responsible for compliance with these laws and regulations. As a participant, for a registration to be accepted, you agree to review, understand, sign and agree to the NemesisBird Terms and Conditions of Booking, Responsibilities, and Assumption of Risk.
Each participant is responsible for meeting and maintaining all the legal requirements for the destinations visited on the tour, and for possessing and meeting all required documentation for travel.
Tour Registration and Cancellation & Refund Policies:
To secure a spot as a participant on a NemesisBird Tour, registration is required. Registration requires a deposit and final tour payment for the purchase of an available space on the tour. It also requires reading and accepting the documents associated with the tour, and signing the release waiver, either online or via the mail/courier service.
Tour registration is your agreement with NemesisBird LLC’s Terms and Conditions, Responsibilities and Assumption of Risk, as well as the Cancellation Policies described herein. For any tours or events offered in partnership with other companies, note that their Terms and Conditions and deposit requirements apply as well. Note that NemesisBird’s tour service commences upon registration and includes pre-tour preparation and administration services, so if a guest makes a cancellation prior to final payment, NemesisBird retains some portion of the payment. Review the tour itinerary carefully and see the tour price information for what is included or excluded in tour costs, for information on when final payment is due, and to see cancellation policies specific to that tour. Otherwise, the cancellation policies are noted below.
The tour fee (or tour price) and deposit amounts are noted on the tour pages (and the booking pages aka Book Now linked to WeTravel). Deposits are due at the time of registration and may be paid by check or credit card. Full payment of the balance of the tour is due at least 120 days prior to departure, or as noted on each tour’s web posting.

Credit card payments of the tour deposit may be made via WeTravel. Other forms of electronic payments may also be possible, including using Zelle, or via bank transfers or wire transfers provided guest/participant assumes any bank charges associated with said transfer. For some tours, we only accept checks or ACH payments for final tour payment.
NemesisBird reserves the right to cancel any tour prior to departure. NemesisBird reserves the right to change hotels as needed, to alter the tour itinerary, and to substitute a tour's guide(s)/leader(s) on any tour. NemesisBird reserves the right to adjust a tour's price prior to departure, including for when exchange rates change significantly or if tariffs or other costs are imposed that alter the finances of the tour's operation.
NemesisBird, in its sole discretion, reserves the right to refuse service, and/or to decline any participant’s registration form, or to refuse to allow any tour guest/participant to participate in a tour.
Our programs specialize in viewing birds and other wildlife - every effort is made to plan programs where target species are known to exist. However, we cannot fully predict or control their movement patterns. In an attempt to locate target wildlife which may have deviated from its normal pattern or in the interest of traveler comfort and/or safety, we may be required to make reasonable changes in itineraries with little notice. If it is necessary to change hotels, boat charters/dates, or other facilities then NemesisBird will make every attempt to find comparable accommodations to be substituted wherever possible. Additional costs incurred by these changes may require the program fee to change with little or no notice.
Should NemesisBird be required to cancel a trip due to unforeseen circumstances, travelers will be refunded for their trip cost, but NemesisBird will not be liable for accompanying expenses (such as gear purchases, airline tickets, etc.).
We understand how disappointing it is for travelers in the event they are forced to cancel their adventure, especially one that they have been looking forward to for a long time. We too plan for these adventures well in advance of departure and we must continuously send non-refundable payments to hotels and other suppliers to hold our dates. Therefore we must strictly adhere to our Cancellation & Refund Policy for all travelers.
All cancellations must be made in writing. Unless otherwise clearly noted on the specific tour’s web posting, all cancellations made outside the deadlines listed below require a $100 cancellation fee, per participant, to cover administrative costs incurred.
For all of our land-based tours, cancellations made less than 90 days prior to the departure date require a loss of 100% of the entire program fee including all extensions.
For our boat-based charter tours (4-day Dry Tortugas, etc), cancellations made less than 120 days prior to the departure date require a loss of 100% of the entire program fee including all extensions.
A refund will be issued (minus a $500/person processing fee) for all tours cancelled 121 days or more prior to the departure date.
NemesisBird and our cooperating agents make every effort to select reliable suppliers and contractors to provide boat, air, and other transportation in addition to hotels, local guides, and other travel related services; we do not assume responsibility, directly or indirectly, for any loss, damage or injury to property or person in connection with such services. Each traveler agrees not to hold NemesisBird LLC, its owners, employees, agents or representatives liable, in the absence of their own gross negligence, for any loss or injury, expense, or damage which results directly or indirectly from any act or omission of any person or firm which is to or does provide goods or services in connection with the trip or with any available option.
NemesisBird and its cooperating agents shall not be liable for circumstances arising as a result of Acts of God, weather, detention, annoyance, delays, and expenses arising from quarantine, strikes, theft, pilferage, force majeure, military, political or terrorist action, civil disturbances, government restrictions, failure of any means of conveyance to arrive or depart as scheduled, discrepancies or changes in transit over which they have no control. NemesisBird reserves the right to change the program fee, dates or itinerary with little or no notice. If such changes do occur, no refunds will be made beyond those described in our cancellation policy and NemesisBird will not be liable for expenses incurred as a result of the change (such as air ticket change fees, etc.).
Group Safety, Rooming, & Code of Conduct on Tours:
NemesisBird plans tours in natural areas where the environment can sometimes lead to unpredictable conditions. To avoid possibly dangerous situations, both for our travelers and the wildlife, it is extremely important that all travelers obey the rules and regulations set forth by the Tour Leaders/Guides and/or Local Guides.
We reserve the right to prohibit any traveler from continuing on a journey if, in our opinion, that traveler’s actions pose a threat to the safety of themselves, others, or to the wildlife, or if that traveler’s actions or behaviors are seriously jeopardizing the enjoyment of the trip for others. We aim to provide a safe environment during our tours, and all participants are expected to maintain appropriate standards of behavior by refraining from conduct that may be (or perceived to be) harmful to themselves, other participants, NemesisBird staff, and/or other third parties. Conduct that we find unacceptable on our tours includes but is not limited to: harassment, verbal abuse, unwanted physical contact, deliberate intimidation, inappropriate photography or unwelcome recording of others, sustained disruptions at meals or during field and travel time, any use of epithets or derogatory comments, any use of slurs or unwanted sexual comments, advances, or invitations, any use of inappropriate gestures, any threats or demands or sexual requests, any retaliation, revenge, or retribution for having reported harassment, etc, and failure, refusal, or inability to follow the instructions of our staff and local guides. NemesisBird in its sole discretion, will determine if a participant’s conduct requires corrective measures or if a participant breaches our code of conduct. Consider too that conduct acceptable to one person may be offensive to another. Corrective measures may be taken including verbal warnings, expulsion from the tour with no refund of the tour fee, and/or barring from any future travel with NemesisBird. If a guest believes that they are being subjected to inappropriate behavior as outlined above, then they should alert the tour leader and/or contact the NemesisBird staff. If someone is in immediate danger, contact local law enforcement immediately.
Participation in the program will require that travelers sign releases and covenants not to sue NemesisBird LLC or its participating agents in the absence of their own gross negligence. On advancement of a deposit, the traveler agrees to be bound by the terms and conditions set forth above.
A Note about our Tour Postings & Brochures:
The detailed information provided in our tour postings and brochures is prepared well in advance of departure dates. Due to the nature of the programs we provide, hotels, modes of transportation, and, in some cases, itineraries change. If this does occur, we will attempt to provide similar facilities but are not always able to do so. We hope you understand.
Trip Insurance:
In today’s often unpredictable travel environment, it’s important to protect your travel investment so you can relax and enjoy your trip. Unforeseen events such as flight delays, baggage loss, or even a sudden sickness or injury could impact your travel plans. We highly recommend participants purchase trip insurance to help protect you and your travel investment against the unexpected.
If you choose not to purchase trip insurance, you personally assume significant financial risk. Flight cancellations, medical emergencies of yourself or family members, evacuations, trip cancellations due to force majeure, or other unexpected situations could cost you thousands of dollars. These expenses may be entirely non-reimbursable through any other method.
